Vellie Terms of Service

These Terms of Service ("Terms") are an agreement between you and SJ Origin LLC ("we," "us," "our"), the company that makes Vellie, and govern your use of the Vellie mobile app and the website at vellie.app (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Who can use Vellie

You must be at least 13 years old to use Vellie. If you are under the age of majority where you live, you may use Vellie only with the permission of a parent or guardian.

You are responsible for keeping your login details secure and for everything that happens under your account. Please tell us right away if you think someone has accessed your account without permission.

2. What Vellie does

Vellie helps you keep track of the people who matter to you, reminds you before their birthdays, anniversaries, festivals, and other occasions, and suggests messages and gifts.

Vellie is a reminder and suggestion tool. We do not sell gifts, process purchases, deliver products, or send messages on your behalf.

3. Your content and the people you add

"Your content" means everything you enter into Vellie, including the people you add, their occasions, notes, and details.

• You own your content. You give us permission to store, process, and use it only as needed to provide the Service, including sending the fields described in our Privacy Policy to our AI provider when you use AI features.
• You are responsible for what you add. When you add information about other people, you agree to add only information you are permitted to keep and would be comfortable with them knowing you keep. Do not add sensitive information such as health conditions, financial details, or government ID numbers.
• Imports are your choice. If you import from your phone's calendar or contacts, only the items you select are saved.

4. AI suggestions

Message Ideas and Gift Ideas use artificial intelligence and only work after you turn on AI suggestions. You can turn them off in Settings at any time.

AI-generated suggestions may be inaccurate, inappropriate, or not fit your situation. They are suggestions only. You are responsible for reviewing, editing, and deciding whether to send any message or buy any gift. We may limit how many AI suggestions you can request in a period of time.

5. Reminders

We work hard to deliver reminders on time, but reminders depend on your device, its settings, notification permissions, and factors outside our control. Festival dates that change each year are based on published calendars and may occasionally be approximate. Vellie is a helpful tool, not a guarantee, so please do not rely on it as your only way to remember important dates.

6. Shopping and third-party links

Gift suggestions may link to third-party stores such as Amazon, FNP, and others. Some links may be affiliate links, and we may earn a commission on purchases at no extra cost to you.

Any purchase you make is between you and the store. We are not responsible for third-party products, prices, availability, shipping, returns, or the content or practices of third-party sites. Prices and availability shown in Vellie are estimates and may change.

"Send on WhatsApp" opens WhatsApp, a separate service with its own terms. You choose the recipient and send the message yourself.

7. Acceptable use

You agree not to:

• Use Vellie to harass, stalk, threaten, or harm anyone
• Add content that is unlawful, hateful, or sexually explicit, or that violates someone else's rights
• Try to access other users' accounts or data, or interfere with the Service's security
• Reverse engineer, scrape, or overload the Service, or use automated means to misuse AI features
• Use Vellie in violation of any applicable law

We may suspend or close accounts that break these rules.

8. Subscriptions and payments

Vellie is currently free to use. We may introduce paid features in the future. If we do, we will explain the price and terms before you are charged, and purchases through the Apple App Store or Google Play will also be subject to their terms.

9. Our intellectual property

The Vellie app, name, logo, design, and software belong to SJ Origin LLC or its licensors. We give you a personal, non-transferable, revocable license to use the app for your own non-commercial use, subject to these Terms.

If you send us feedback or suggestions, we may use them without any obligation to you.

10. Ending your account

You can delete your account at any time in Settings. Deleting your account removes your data as described in our Privacy Policy.

We may suspend or end your access if you break these Terms, if required by law, or if we stop offering the Service. If we discontinue the Service, we will try to give reasonable notice.

11. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that reminders or AI suggestions will be accurate or timely.

12. Limitation of liability

To the fullest extent permitted by law, SJ Origin LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or missed occasions, arising from your use of the Service.

Our total liability for any claim related to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US $50.

Some places do not allow these limits, so they may not fully apply to you.

13. Indemnity

You agree to defend and indemnify SJ Origin LLC against claims arising from your content, your use of the Service, or your violation of these Terms or someone else's rights.

14. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Pasco County, Florida, unless applicable law in your country gives you the right to bring a claim where you live.

15. Changes to these Terms

We may update these Terms from time to time. If changes are significant, we will notify you in the app or by email before they take effect. Continuing to use Vellie after the changes take effect means you accept the updated Terms.
